Asset protection planning is all about taking chips off the table in good times, so that you still can walk away from the table a winner no matter what happens in bad times. Those who worry the most about asset protection are those who are the most likely to get sued. However, average folks often get caught up in difficult situations too, and thus if you have something to protect then the topic of asset protection should at least cross your mind. All asset protection planning is based on two premises: that creditors can generally reach any asset owned by a debtor; and that creditors cannot reach those assets the debtor does not actually own. It becomes necessary therefore to make it more difficult and more expensive for a creditor to reach those assets, while enjoyment and the distancing of a debtor from the ownership and control of those assets, are nevertheless realized. In this show, Bill and Rick discuss how each asset “type” is funded and what you should have prepared to ensure that end.
