There are numerous ways in which manufacturers or owners of a product or service arrange to have it sold to the public or wholesalers further down the line of distribution. But by far the most common method is to utilize “distributors” who normally are independent entities who seek sales, pay their own expenses of business, and either buy the product for resale at a markup, or simply process orders. Are you familiar with distributor agreements and whether distributors are applicable to your business model?

The objectives of agents acting under a power of attorney can be frustrated when banks, brokerages, or title companies refuse to accept the authority granted to the agent under a duly executed power of attorney.  This can happen even though the power of attorney appears to be valid.  Do you know why this occurs and how it might be avoided?

An intern is not someone you simply elect to work for you and not pay. If the person is working for you, they are an employee and the Labor Code will apply. However, there is an exception to the Labor Code that allows true interns or externs to come into your place of business and perform tasks without pay, so both can reap benefits. Otherwise, your intention to bring on free labor because you cannot afford to pay someone will expose you to audit by the Labor Commissioner’s office or EDD, and/or liability to any intern who worked for you for up to four years after they leave your employ.   Learn more on this episode of the Bottled Business Sense Show.

There’s a gambling saying that goes something like, “If you want to be a winner, you have to walk away from the table a winner. Asset protection planning is all about taking chips off the table in good times, so that you still can walk away from the table a winner no matter what happens in bad times. Those who worry the most about asset protection are those who are the most likely to get sued. However, average folks often get caught up in difficult situations too, and thus if you have something to protect then the topic of asset protection should at least cross your mind. Prescription drug abuse has made national news in the last few years.  In fact, prescription opioid abuse and the heroin epidemic claims the lives of tens of thousands of Americans each year.
